Racine Man Charged With Homicide After Killing City Employee

Benjamin J Bell, 20 of Racine has been charged with felony Homicide by Negligent Operation/Vehicle and felony 1st-Degree Recklessly Endangering Safety. He was given a $100,000 cash bond after appearing Thursday in Racine Courts. His Preliminary hearing is on December 21, 2016

According to the criminal complaint Racine Police on December 14th, responded to the 4400 block of Washington Avenue for an accident involving a garbage truck and car. Upon arrival officers noticed the smell of marijuana coming from the car driven by the defendant.

Witnesses reported at the scene to law enforcement that they had seen the vehicle driving at a high rate of speed before the accident and swerving in and out of traffic. A passenger in the vehicle told officers that he believed the defendant was going no more 5 mph over the limit and was texting and looked up and the truck was right in front of them, the complaint reads

Mark Gates, the victim was taken to Ascension/All Saints and then transferred to Froedert Hospital where he passed away from his injuries Wednesday afternoon.

The complaint states that the investigation is ongoing and may result in additional charges
